Terms of Service

These Terms of Service govern the sale and supply of building materials by SWB Steel, Cement & Building Materials, a trade name of TRUEHERTZ ("SWB", "we", "us"), operating from 816, NICE Service Road, Banashankari 6th Stage 7th Block, Sompura, Bengaluru, Karnataka 560060.
By placing an order with us — in person, by phone, by WhatsApp, through our customer portal, or through this website — you agree to these Terms.
1. ABOUT US
SWB is an authorized dealer and supply partner for TMT steel, cement, paints, putty, binding wire, nails and hardware, serving builders, contractors, engineers, architects and homeowners across South Bengaluru.
2. ORDERS
2.1 An order is confirmed only when we acknowledge it in writing (WhatsApp, email, invoice or order confirmation) and the agreed advance or full payment is received.
2.2 We may decline or cancel any order where stock is unavailable, prices have changed, delivery is not feasible to the given location, or payment is not received.
2.3 Quantities, brands, grades and specifications are as stated in the order confirmation or invoice.
3. PRICING AND TAXES
3.1 All prices are quoted in Indian Rupees and are exclusive of GST unless stated otherwise. GST is charged at applicable rates and shown separately on the tax invoice.
3.2 Building material prices — particularly steel and cement — fluctuate frequently. Quoted prices are valid only for the period stated in the quotation, and otherwise until the end of the day of quotation.
3.3 Prices are firm once an order is confirmed and paid for.
4. PAYMENT
4.1 We accept cash, UPI, debit and credit cards, NEFT/RTGS and online payments through our payment gateway.
4.2 Orders may require full advance payment or a part advance, as agreed at the time of order.
4.3 Credit terms, where extended, are at our sole discretion and subject to a separate written arrangement. Overdue amounts may attract interest as stated in the invoice.
5. DELIVERY
5.1 We deliver to construction sites within our service area in South Bengaluru. Delivery timelines communicated to you are estimates made in good faith and depend on stock availability, traffic, weather and site access.
5.2 The customer must ensure safe, legal and reasonable vehicle access to the delivery site, and must arrange any permissions required for unloading.
5.3 Where site access is not possible, materials will be unloaded at the nearest safe accessible point.
5.4 Risk in the goods passes to the customer upon delivery at the agreed location.
5.5 Waiting charges or re-delivery charges may apply if a vehicle is delayed or turned away at the site for reasons not attributable to us.
6. WEIGHT, QUANTITY AND QUALITY CHECKS
6.1 We supply materials at accurate weight and in original manufacturer packaging or bundles with brand tags intact.
6.2 The customer or their representative must verify quantity, weight, brand, grade and condition AT THE TIME OF DELIVERY and record any discrepancy on the delivery challan before signing it.
6.3 Claims regarding shortage, damage or incorrect material must be raised at the time of delivery, or within 24 hours of delivery with photographic evidence. Claims raised after this period cannot be accepted, as materials leave our control once unloaded at site.
7. PRODUCT WARRANTIES
7.1 All products are sold with the manufacturer's warranty only. SWB does not provide any independent warranty.
7.2 Any manufacturing defect claim will be forwarded to and handled by the respective manufacturer, and we will assist the customer in that process.
7.3 We are not responsible for material performance affected by improper storage, handling, mixing, workmanship or construction practices at site.
8. STORAGE ADVICE
Cement is moisture-sensitive and must be stored in a dry, covered area and used within the manufacturer's recommended shelf life. TMT steel should be stored off the ground and protected from prolonged exposure. We are not liable for deterioration caused by improper storage after delivery.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, our total liability in respect of any order shall not exceed the invoice value of the materials supplied in that order. We are not liable for indirect or consequential losses, including construction delays, labour costs or loss of profit.
10. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
